Terms of Service

1. Service Overview

These Terms of Service ("Terms") govern the use of the HeroMyStory (storybook) service ("Service") operated by GH International Group LLC ("Company", "We", "Us").

The Service is a platform that generates personalized storybooks, including illustrations, narration, and voice, based on photos uploaded by users.

2. Eligibility

To use the Service, you must log in via your Google account. As per Google's Terms of Service, only users aged 13 and above can create an account, and this Service applies the same age restriction.

The creation of storybooks using photos of children under 13 is only permitted for their legal guardians, who are deemed to have agreed to these Terms.

3. Ownership of User Content

All content generated through the Service (storybooks, images, text, audio, etc.) is exclusively owned by the user.

The Company does not claim any copyright, ownership, or license to the generated content. Users are free to use, modify, distribute, and commercially exploit the generated content.

However, the scope of copyright protection for AI-generated content may vary by country's laws, and the Company does not guarantee this.

However, if you make content public in the community, the Company may use that public content, thumbnails, and comments on a non-exclusive basis within the Service for operation, display, recommendation, and promotion. New exposure stops when you switch it to private or delete it.

4. Disclaimer for AI-Generated Content

The Service utilizes OpenAI and Google Gemini AI models to generate content. Due to the nature of AI-generated content:

• Generated images, text, or audio may contain unintended content.
• Different results may be generated for the same input each time.
• Accuracy in facial reproduction is not guaranteed.
• Some requests may be rejected by content safety filters.

5. Fees and Payment

The Service currently offers the following paid options and usage limits.

• Payments are processed through Stripe and are automatically renewed monthly.
• Subscription cancellation can be done through the Stripe customer portal or the plan page within the Service.
• After cancellation, you can continue to use premium features until the end of the current billing period.
• Refunds for fees already paid are generally not provided.
• However, duplicate charges, obvious system errors, or refunds required by applicable law may be reviewed separately and refunded or adjusted as appropriate.

6. Prohibited Activities

• Uploading photos of others without their consent.
• Attempting to generate illegal, harmful, or content that violates public order.
• Breaching the security of the Service or attempting unauthorized access to the system.
• Sending mass requests through automated means.
• Posting inappropriate content in the community gallery.
• If a violation is suspected or confirmed, the Company may stop generation, hide content, remove posts, or restrict account access as needed.

7. Service Interruption and Modification

The Company may modify, suspend, or terminate all or part of the Service without prior notice. The Company is not liable for any damages resulting from service interruptions.

8. Account Termination

Users can delete their accounts at any time. Upon account deletion, all storybooks, photos, chat history, and scenarios will be permanently deleted and cannot be recovered.

9. Governing Law and Dispute Resolution

These Terms shall be interpreted in accordance with the laws of the State of New Mexico, USA. Any disputes related to these Terms shall be subject to the jurisdiction of the courts located in Albuquerque, New Mexico.

10. Changes to Terms

The Company may change these Terms from time to time. Changes to the Terms will become effective through notice within the Service.
